As a condition of acceptance of my entry in The Yarra Bay Challenge (The Event), I hereby waive for myself, my heirs, assigns, executors, administrators or anyone else who is associated with me in any way whatsoever, all and any claim, right or cause of action legal or otherwise, which I or they might otherwise have arising out of or consequent upon my entry and or participation in the said event. I agree that this waiver, indemnity, release, discharge and the like (as aforementioned) shall operate in favour of and hold harmless all persons, corporations, and bodies and their employees, servants, agents, contractors, representatives and the like involved in or otherwise engaged in the promoting, staging, administering, running, controlling or in any way connected with this event in whatever or howsoever manner in respect of all actions, suits, demands, claims, proceedings, costs, expenses, liabilities and judgements and the like, arising out of or in relation to my entry and or participation in this event and whether or not the loss, injury, damage or the like is attributable to the act or neglect of any one or all of them. I hereby agree that I participate in this event solely at my own risk and that I am aware of the inherent dangers of participating in an event of this nature. I agree to follow all rules and regulations and all requests made of me by race organisers, officials, or anyone else involved in the running of the event. I hereby agree that I have sole responsibility, for myself, my personal possessions, my athletic equipment and the like during the event and its related activities. I hereby attest and verify that I possess the requisite

skills and am physically fit and am not suffering from any illness or condition or other physical malady that may put me or any other person at risk at or during the event and its associated activities. I also attest and verify I have done sufficient training for this event so that I shall not put myself or any other person associated with the event in danger. If requested I agree to provide a signed medical certificate attesting to my physical fitness to participate in this event.

I hereby consent to receive such medical aid or treatment that may be deemed advisable in the unfettered discretion of the Officials of this event and I agree that should it be deemed necessary to be transported to the nearest medical facility and hospital for treatment. I hereby consent to the free use of my name and or picture in any newspaper, promotional advertising material, email address database, video, broadcast, telecast and the like, as may pertain to the event. I hereby agree that in the event of cancellation due to storm, rain, inclement seasonal weather, winds, "Act of God" conditions or for any reasons considered by the officials that make the event unsafe in any way, then my entry fee shall be non-refundable. I affirm that I have full authority to sign this document and that I have read, understood and accept its terms. I also agree that this waiver/indemnity maybe pleaded as a bar to any action, claim, or legal proceeding. I have truthfully and accurately completed all information required for entry and have read, understood and agree with the conditions, rules and agreement waiver and indemnity on the reverse side of the entry form.

Competition Rules

Ski

• Online entries close on the 01 March 2008; competitors may register at the event, prior to 8am.
• Competitors must have attained the age of 18 years or older on the day of an event to compete
• All competitors must complete and sign a waiver prior to competing
• All competitors must display race number on their craft whilst competing
• All competitors must wear a Yarra Bay Challenge race singlet whilst competing
• The event is for SLSA specification surf skis and Ocean Racing Skis. Within each competitive category no differentiation is made between craft as to prize eligibility
• The course description provided is subject to change by the Race Director
• The Race Directors decision is final
• No wash riding of craft or boats not in the race, or accepting outside assistance
• The organisers have a duty of care to all those participating in the event and therefore competitors are advised that First Aid personnel are the final arbitrators as to your continuation in the event for health reasons and to disregard their directions may mean exclusion by the Race Director.
• The organiser reserves the right to reject or cancel any entry to the race at anytime, for any reason including but not limited to; ignoring official's instruction, medial concerns and unsportsmanlike behaviour
• No event placing, prize money or medals will be issued to any competitor not registered in an event
• This is a demanding event. The event organisers cannot guarantee your safety. Possible risks include injury and/or drowning, due to being hit by other persons, objects or boats, other hazards include, rips, rocks, sandbars, blue bottles, stingrays and sharks. Competitors enter at their own personal risk and are responsible for their own physical condition.

Swimmers

• All swimmers must swim the prescribed course and ensure that their name is marked off the official entrants register at the conclusion of the swim even if they do not complete the course.
• Swimmers must swim in the category for which they are eligible.
• All swimmers must wear their prescribed cap, race number and timing device.
• A swimmer may not use extraneous aids eg. flippers, snorkels or flotation clothing or devices.
• Any swimmer accompanying an under 15 year aged swimmer will not be eligible for a prize or qualify as an official placegetter.
• All swimmers are to behave in a fair and sportsmanlike manner without interference or aggression towards other competitors and any breach of this rule may result in disqualification from the Yarra Bay Challenge.
• If in the opinion of an event medical officer or a water safety official a competitor is physically or otherwise incapable of starting or completing the swim or has been in the water for an inordinate time such competitor may be disqualified from starting or be removed from the water at any time.
• If in the opinion of the Club the weather or swimming conditions are dangerous or unsuitable the Yarra Bay Challenge may be cancelled without notice.
• Prize winners must be present to receive their prize

Risk Warning (Section 5M Civil Liability Act 2002)

Warning is given to all Entrants in the Yarra Bay Challenge that there is the risk of harm to their person and/or property arising from any inadequacy of physical condition or stamina to complete the swim, hazardous sea and beach/bay conditions including sea currents and waves and the presence of sea craft and sea creatures and other hazards.
